Failed Uber's Background Check: Is It a Deactivation?

Uber calls a failed background check a 'loss of eligibility,' not a deactivation, so the Review Center usually can't help. What it checks and what you can do.

Short answer: Uber says that failing its background check is "considered a loss of eligibility, not a deactivation," though local law may treat it as one. In practice, that means the normal appeal in the Review Center usually does not cover it. Your options are to check the report for mistakes, fix what can be fixed, and get legal help if the report is wrong or unfair. Your TLC license is a separate matter: Uber's decision does not by itself change it.

What Uber's background check looks at

Uber's page Deactivations — Losing Account Access lists these background check reasons:

  • felonies and other serious criminal offenses;
  • pending criminal charges;
  • recent or multiple moving violations or accidents;
  • driving with a suspended license or without insurance;
  • serious driving violations such as DUI, reckless driving or hit-and-run.

Uber says checks may cover your adult history from age 18.

Why the Review Center usually can't help

Uber says most access removals can be reviewed in the in-app Review Center, but background check failures are generally excluded unless local law says otherwise. Uber's NYC driver panel (described on a 2020 page) is for deactivations; Uber decides eligibility for it case by case. See Uber's NYC appeals panel.

TLC license vs app eligibility

These are two different decisions:

So you can have an active TLC license and still fail Uber's check, for example after a new moving violation or a pending charge. The opposite can also happen. Check your TLC status separately at (718) 391-5501, option 2.

NYC's deactivation law (Local Law 52 of 2026) would cover deactivations that are not for just cause, but it is blocked by a federal court since July 2026. See NYC deactivation law.

Real-Time ID Check is different

A failed Real-Time ID Check is listed by Uber as a safety reason, not a background check. The real-time selfie must match your profile photo. Uber says common errors include photos of photos and letting others take the photo, and that sharing an account is not permitted in the US. If you failed it by mistake (bad light, a new beard, glasses), request a review in the app and explain. See can someone else use my Uber account.

What you can do

After a failed background check

If the report has an error, ask the background check company and Uber to correct it, and keep copies of what you send. Rules about background reports are legal questions; a lawyer can tell you what applies to you. See free legal help for drivers. If you were also asked to take a drug test, see TLC drug test for TLC's separate requirements.

Watch out for "account fix" scams

Uber says it will "never call, text, or email you to request your password, verification code, or banking details" (Uber). Anyone who offers to "clear" your background check or unlock your account for a fee, or asks for your login code, is a red flag. Only use the app, Uber's help site, or an organization you can verify.

To see every path for app removals, use the deactivation path finder. This is general information, not legal advice.

Frequently asked questions

Can I appeal a failed Uber background check in the Review Center?

Usually not. Uber says losing access for a failed background check is considered a loss of eligibility, not a deactivation, and that background check failures are generally excluded from Review Center reviews unless local law says otherwise.

I have a TLC license. Why did I fail Uber's check?

Your TLC license and Uber's eligibility are separate decisions. TLC decides whether you can hold a license; Uber decides who can use its app. Uber's criteria include things like pending charges and recent or multiple moving violations or accidents, which can change after TLC licensed you.

Is a failed Real-Time ID Check a background check failure?

No. Uber lists failed Real-Time ID Checks under safety reasons. The real-time photo must match your profile photo. Uber says common errors include taking a photo of a photo and letting someone else take the photo. These cases go through the normal review process.
