Utilization rate is the share of drivers' working time — or miles — that is spent with a passenger in the car. In NYC it is a key part of the minimum pay formula for Uber and Lyft drivers: TLC divides the base pay amounts by the utilization rate, so that the pay for each trip minute and trip mile also pays you for the time and miles between trips.

TLC's rule defines it as "the percentage of time or distance, in aggregate, that all Drivers who have made themselves available to accept dispatches from High-Volume For-Hire Services spend transporting passengers" on their trips (§59D-03(j)). The bottom of the fraction is all the time or distance drivers are available, driving to a pickup, or carrying a passenger.

Current numbers (rule §59D-22(b), checked 2026-10-12)

  • 53.3% — applied time utilization rate, used for the per-minute rate.
  • 68.5% — applied distance utilization rate, used for the per-mile rate.

Both were set by the June 2025 rule, using data from May 2023 to April 2024, "the most recent 12-month period in which HV companies were not using lockouts." Before that, a single 58% time-based rate was used for both parts (TLC rule notice). TLC now changes the rates only through rulemaking, not automatically.

How it works, step by step

  1. Start with a base amount

The rule sets a base, e.g. $0.850 per passenger mile for a non-WAV car.

  2. Divide by utilization

    $0.850 ÷ 68.5% ≈ $1.241 per passenger mile.

  3. Add yearly inflation

After the March 1, 2026 increase of 3.36%, the published rate is $1.283 per mile (and $0.681 per minute).

  4. Apply to each trip

Trip miles × $1.283 + trip minutes × $0.681 = the minimum for that trip. The utilization is already inside the rates.

TLC's own example: if drivers are logged in for two million hours and carry passengers for one million, utilization is 50%, and a trip worth $20 before utilization pays $40.

Where drivers see it

Not on your pay statement — it is built into the per-mile and per-minute rates. You feel it in your hourly earnings: if you are busier than the industry average, you earn more per hour than the formula assumes; if you wait longer, you earn less.

Frequently asked questions

What is the utilization rate in TLC driver pay?

The percentage of time or distance, across all drivers available to Uber and Lyft, spent carrying passengers on their trips (TLC rule §59D-03). TLC divides the base per-minute and per-mile pay amounts by it, so that pay for trip time also covers waiting and driving to pickups.

What are the current utilization rates?

Rule §59D-22(b) sets an applied time-based rate of 53.3% for the per-minute part and a distance-based rate of 68.5% for the per-mile part. Both came from data for May 2023 to April 2024.

Does my own utilization change my pay rate?

No. The applied rates are industry-wide and the same for every driver. Your own busyness changes how much you earn per hour, not the per-mile or per-minute rate.
