Short answer: no hourly minimum wage is guaranteed. Uber and Lyft drivers in NYC are paid under a per-trip minimum set by TLC rule §59D-22 — as of March 1, 2026, at least $1.283 per mile and $0.681 per minute with a passenger (non-WAV) (TLC, checked 2026-10-12). When TLC created it in 2018, it said the standard was meant to equal $27.86 an hour gross, or $17.22 an hour after expenses for drivers (TLC press release). Whether you reach that depends on how busy you are.

The numbers and where they come from

TLC described the $17.22 figure as "the minimum wage standard for independent contractors, who pay additional payroll taxes and do not get paid time off." TLC's expense study also describes app drivers as working "as independent contractors using vehicles they own or rent." For them, the minimum is set by the TLC per-trip formula, not by an hourly wage.

What the number does and doesn't mean

It is per trip, not per hour. You earn the minimum only while a passenger is in the car. To cover waiting and driving to pickups, the rule divides the base amounts by a utilization rate — the share of all drivers' available time (53.3%) and miles (68.5%) spent with passengers (§59D-22(b)). If you are busier than average, your hourly pay is higher than the target; if you sit idle longer than average, it is lower. See utilization rate and what utilization means for my pay.

The apps mostly pay the floor. In our check of TLC trip records from March to August 2026, three-quarters of in-city trips were paid within 1% of the minimum formula (pay per trip data).

"After expenses" is an average. The 2018 target assumed average car costs. TLC's 2025 expense study puts an owned gas car at $0.753 a mile and a rented one at $1.028 (cost per mile). Renters keep less.

Lockouts. When the companies limit who can log in, utilization rises but drivers lose hours. Since TLC's June 2025 amendments, a company must give 72 hours' notice before blocking you from accepting trips on a day, and once you are available it must let you stay available for 16 hours (the count restarts after 8 hours away), with exceptions for licensing problems, TLC rule violations and company-policy violations such as misconduct or excessive cancellations (§59D-22(c)). Details: the 72-hour and 16-hour rule.

Tips are separate. TLC's data keeps tips (and tolls) out of driver_pay, and the company must pass the whole tip to you (§59D-17(b)).

What to do next

  1. Check a few trips with the minimum pay estimator: miles × $1.283 plus minutes × $0.681 (higher for WAV and out-of-town miles).
  2. Track your own hourly result: total pay plus tips for a week, divided by hours logged in, minus car costs.
  3. If a trip paid less than the minimum, email driverprotection@tlc.nyc.gov or call (718) 391-5539 with the trip date, time and receipt (TLC Driver Pay).

Frequently asked questions

Is there a minimum hourly wage for Uber drivers in NYC?

No. TLC rule §59D-22 sets a minimum payment per trip, based on the miles and minutes you carry a passenger. There is no guaranteed amount per hour you are logged in.

Why do people say NYC Uber drivers get $17.22 an hour?

When TLC adopted the pay rules in December 2018, it said the per-trip standard was the equivalent of $27.86 an hour gross, or $17.22 an hour after expenses, for drivers. That was a design target for an average driver, not a promise to each driver.

How does the per-trip minimum cover waiting time?

Through the utilization rate. TLC divides the base per-minute and per-mile amounts by the share of time (53.3%) and miles (68.5%) that drivers carry passengers, so each paid minute and mile also pays for some unpaid waiting and driving.

What can I do if I think I was underpaid?

Compare the trip with TLC's rates ($1.283 a mile and $0.681 a minute for non-WAV trips since March 1, 2026), then contact TLC's Driver Protection Unit at driverprotection@tlc.nyc.gov or (718) 391-5539 with the trip details.
