Old taxicab owner rules (medallion owners)

Old Chapter 1 of the TLC rules covered owners of yellow medallion taxicabs: keeping the cab licensed, insured, inspected and in good condition, the taximeter and roof light, lease caps, and owner conduct. It was repealed on April 1, 2011, when the new TLC rule book took effect. Its rules moved mostly to Chapter 58 (Medallion Taxicab Service); the TLC's 2011 'Guide to New TLC Rules' maps old 1-xx sections to new 58-xx sections.

§1-49A

§1-49AOld rule — repealed16 charges

Unspecified-driver filing missing master lease or insurance proof

An owner who chose to run a cab with unspecified drivers had to file, along with the driver authorization statement, a copy of the master lease, employment agreement or union contract, plus proof of insurance covering unnamed drivers. This charge says those papers were not filed. It was written to the owner.

Rate card entries for the owner's driver choices

This subdivision says the TLC will enter the owner's driver choices on the rate card: named drivers of record and lease end dates, or "Unspecified Drivers." It describes what the TLC does, and the old penalty schedule lists no penalty for §1-50. A charge under it most likely means the rate card did not match how the cab was actually being driven (see also §1-47).

Leasing a taxi without following the owner rules

An owner could lease a cab to a licensed taxi driver, or to several licensed drivers on different shifts or days, only while following the leasing rules. Whatever the lease said, the owner stayed responsible for obeying all laws and rules for owners. The old schedule lists no separate penalty for §1-50. Leasing is now covered by §58-21(a).

Owner required a driver to work more than 12 hours straight

An owner could not require a driver to drive one or more cabs for more than 12 hours in a row. This charge says the owner (or garage) made a driver work a longer shift. It is a safety rule against driver fatigue and was written to the owner. The current rule is §58-20(a).

This code cites the whole list without saying which item was missing. It was written to the medallion owner. The current list is in §58-33(a).

No driver's trip sheet in the taxi

The driver's written trip record, called the "trip sheet," had to be in the cab while it was working. After cabs got the taxicab technology system (about 2008), a paper trip sheet was needed only when that system was down for up to 48 hours after a reported failure. This charge says the trip sheet was missing. It was written to the owner.

Probably a missing-item charge from the required-papers rule

Section 1-52 (items required to be in the taxi) has only a subdivision (a) in the 2004 and 2010 texts, so "(b)" does not match a real subsection. It was most likely meant as §1-52(a): a required paper (trip sheet, hack license, rate card, insurance card or notice) was missing from the cab. It was written to the owner.
