Driver rules (all TLC-licensed drivers)
Chapter 80 holds the rules for every TLC-licensed driver — yellow taxi, green cab (street hail livery) and for-hire vehicle including app-based drivers: licensing, traffic safety, passenger service, fares, refusals, required items, trip records and the critical driver and persistent violator point programs. It took effect on October 26, 2016, when the universal TLC Driver License replaced the separate taxi and FHV licenses, and it replaced Chapters 54 and 55.

§80--13
§80-04
Physical and mental fitness requirement for TLC drivers
Section 80-04(e) says a TLC driver must be of sound mental and physical condition and fit to drive safely. Fitness is certified by a doctor on TLC forms, TLC can order an exam by a doctor it chooses for good cause, and a license can be suspended or revoked if the driver does not get examined. A charge under this code usually follows a TLC notice about a medical exam. The rule book lists no fixed fine for it.
35 RCNY §80-04(e)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Not getting a TLC-ordered medical exam
Under §80-04(e)(4), an existing TLC Driver License can be suspended or revoked if the driver fails to be examined for a physical or mental condition. These charges (mostly heard 2017–2019) follow a TLC directive to see a doctor and file the fitness form. The rule book lists no fixed fine; the outcome is usually about the license itself. Proof that you completed the exam is the key document.

§80-10
Not reporting a lost or stolen TLC license within 72 hours
A driver must tell TLC in writing within 72 hours (not counting weekends and holidays) when their TLC Driver License is lost or stolen. This charge means TLC says the report was late or never made. Keep a copy of your written report and any replacement request.
- Fine (published)
- $50. Appearance not required.

Unreadable TLC license not turned in for replacement
If your TLC Driver License becomes unreadable or unrecognizable (worn, faded, cracked or damaged), you must turn it in to TLC right away for a replacement. Inspectors, often at airports, write this charge when the license on display cannot be read. A replacement license costs $25 under §80-07(e).
- Fine (published)
- $50. Appearance not required.
35 RCNY §80-10(b)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Altering a TLC license or its photo
A driver must not change any part of their TLC Driver License or the photo on it in any way. This covers writing on it, covering parts of it, or swapping or altering the picture. More serious misuse, such as letting someone else use your license, is charged separately under §80-11(e).
- Fine (published)
- $50. Appearance not required.
35 RCNY §80-10(d)TLC Rule Book, Chapter 80 (updated June 6, 2025)
License photo no longer looks like the driver
When a driver's appearance changes significantly (for example a big change in facial hair, weight or hairstyle), the driver must contact TLC and have a new license photo taken at TLC offices. Inspectors use this charge when the photo on the license doesn't match the person driving. Getting a new photo taken resolves the issue going forward.
- Fine (published)
- $50. Appearance not required.

§80-11
Driving without a valid TLC or paratransit license
Section 80-11(a) bars driving a taxi, for-hire vehicle or green cab in NYC while your TLC Driver License is revoked, suspended or expired (paragraph 1), and bars a paratransit driver from driving an accessible green cab while their paratransit license is not valid (paragraph 2). Driving after expiration and before a renewal is issued is unlicensed activity. Proof your license was valid that day is the main defense.
- Fine (published)
- First violation: $350. Second within 36 months: $500. Third: revocation. Appearance not required.
35 RCNY §80-11(a)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Driving with a suspended, revoked or expired TLC license
A driver must not operate a taxi, FHV or green cab in New York City while their TLC Driver License is revoked, suspended or expired. Driving after the license expires and before the renewal is issued counts as unlicensed activity, which can also lead to vehicle seizure. Proof that your license was valid, renewed, or that a suspension had already been lifted is what matters.
- Fine (published)
- First violation: $350. Second within 36 months: $500. Third: revocation. Appearance not required.

Paratransit driver operating a green cab without a valid license
Holders of a paratransit driver's license may drive only accessible Street Hail Liveries (green cabs). This paragraph says such a driver must not do so while their Paratransit Driver's License is revoked, suspended or expired. It is the paratransit-license version of §80-11(a)(1).
- Fine (published)
- First violation: $350. Second within 36 months: $500. Third: revocation. Appearance not required.
35 RCNY §80-11(a)(2)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Driving without a valid chauffeur's license
Your TLC license depends on a valid New York chauffeur's license (class E or equal). A driver must not drive a taxi, FHV or green cab without one, and TLC summarily suspends the TLC license of a driver who does. Proof your chauffeur's license was valid on the date, or has been restored, is the key evidence.
- Fine (published)
- First violation: $350 and suspension until compliance. Second within 36 months: $500 and suspension until compliance. Third: revocation. Appearance not required.
35 RCNY §80-11(c)(1)TLC Rule Book, Chapter 80 (updated June 6, 2025) Full explanation
Driving while NY State driving privileges are suspended or revoked
In the current rule, §80-11(c)(2) bars driving a taxi, FHV or green cab while your New York State driving privileges are suspended or revoked. In the 2016–2019 versions of the rule book, (c)(2) instead required FHVs that are not exempt from NYS DOT rules to comply with Article 19-A of the Vehicle and Traffic Law. The change came between the Sept 2019 and Oct 2023 texts, so charges from 2021–2022 could be under either meaning; check the summons description. Both versions share the same penalty box.
- Fine (published)
- First violation: $350 and suspension until compliance. Second within 36 months: $500 and suspension until compliance. Third: revocation. Appearance not required.
35 RCNY §80-11(c)(2)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Article 19-A compliance or license surrender (depends on date)
This paragraph changed meaning. In the 2016–2019 rule book, §80-11(c)(3) required a driver to immediately surrender the TLC license when their chauffeur's license was revoked ($100 fine). In the current rule book, (c)(3) says a driver of an FHV that is not exempt from NYS DOT rules must comply with Article 19-A of the Vehicle and Traffic Law (bus-driver style checks); breaking it is treated like driving without a valid license ($350 and suspension until compliance for a first violation). Check the date and description on your summons.
35 RCNY §80-11(c)(3)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Knowingly driving an unlicensed vehicle for hire
A TLC driver must not knowingly drive a vehicle for hire unless it is a licensed taxicab, for-hire vehicle or Street Hail Livery. This charge is about the vehicle, not your own license: for example carrying paying passengers in a personal car or a car whose TLC plate has expired. You must appear at the hearing.
- Fine (published)
- $350 and/or a 5- to 30-day suspension. Appearance required.

- Fine (published)
- $10,000 and revocation. Appearance required.

Missing the annual TLC drug test
Most TLC drivers must take a drug test every year at their own expense. In years one and two of a three-year license the test must be done within the 90 days before the license anniversary; in year three, within the 90 days before expiration. Missing an interim deadline means summary suspension until you test, and a $200 fine if you are more than 30 days late. Missing the year-three window means the license expires and is not renewed.
- Fine (published)
- Summary suspension until compliance; $200 if compliance is more than 30 days after the deadline (§80-14(d)(3)–(4)). Appearance not required.

Missing the first-year annual drug test
In the first year of a three-year TLC license, the annual drug test must be taken no sooner than 90 days before the license's one-year anniversary and no later than that date. A driver who misses it is summarily suspended until they test. Taking and passing the test ends the suspension.
- Fine (published)
- Summary suspension until compliance; $200 if compliance is more than 30 days after the deadline. Appearance not required.

Driving over the 10-hour daily limit
A TLC driver must not carry passengers for more than 10 hours in total in any 24-hour period. Only time with passengers on board counts, and trips from all apps and bases are added together. Eight straight hours with no passengers resets the count, and it is a defense if one trip that started before the limit pushed you over.
- Fine (published)
- Hours above the daily limit: No more than 1 hour over: $50 (plead guilty before a hearing) / $75 (found guilty after a hearing). Over 1–2 hours: $100 / $150. Over 2–3 hours: $150 / $200. Over 3–4 hours: $200 / $300. Over 4 hours: $300 / $400. Three or more violations in a calendar month of 4+ hours over also bring a 5–15 day suspension. Appearance not required.

Driving over the 60-hour weekly limit
A TLC driver must not carry passengers for more than 60 hours in total in any Monday-to-Sunday week. Only time with passengers counts, trips from all apps and bases are combined, and hours already used for a daily-limit violation are not counted again. It is a defense if one trip that began before the limit pushed you over.
- Fine (published)
- Hours above the weekly limit: No more than 1 hour over: $50 (plead guilty before a hearing) / $75 (found guilty after a hearing). Over 1–2 hours: $100 / $150. Over 2–3 hours: $150 / $200. §80-15
General rules while operating a TLC vehicle
Section 80-15 is a group of everyday operating rules for all TLC drivers: no weapons, no smoking, no locking rear doors on passengers, E-ZPass, passenger limits, front-seat use, no selling to passengers, no subleasing a taxi, courtesy, base parking and nuisance, horn honking, and interior advertising. This code cites the section without the subdivision, so check the summons description to see which rule was meant.

Having a weapon in the vehicle
While operating a vehicle, a driver must not have a weapon, or anything meant to be used as one, on them or in the vehicle without the TLC Chair's written permission. The penalty is revocation and you must appear. Get representation.
- Fine (published)
- Revocation. Appearance required.

Smoking in a TLC vehicle
A driver must not smoke in a TLC vehicle (taxi, FHV or green cab). The rule book marks this charge 'appearance required', so you must take part in the OATH hearing rather than just pay. If a passenger smokes, a different rule lets you ask them to stop and end the trip safely.
- Fine (published)
- $150. Appearance required.

Locking the rear doors on passengers
Section 80-15(c) covers door locks. While on duty, a driver must not lock either rear door unless the passenger agrees or asks, or a rule allows it (paragraph 1). Front doors may be locked, but a driver must not use locked front doors to refuse a party of four (paragraph 2). The penalty depends on whether the passenger was inside or outside.
- Fine (published)
- Paragraph (1), passenger inside: $300 if you plead guilty before a hearing; $400 if found guilty after a hearing and/or a 5- to 30-day suspension, 2 points. Passenger outside: $50 / $100. Appearance required.
35 RCNY §80-15(c)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Locking the rear doors without the passenger's consent
While on duty, you must not lock either rear door unless the passenger agrees or asks, or a TLC rule gives a reason (for example when going off duty). If a passenger was inside, the penalty is much higher and carries 2 points. If the passenger was outside, such as trying to get in, the fine is lower. Front doors may be locked.
- Fine (published)
- Passenger inside the vehicle: $300 if you plead guilty before a hearing; $400 if found guilty after a hearing, and/or a 5- to 30-day suspension. Passenger outside: $50 / $100. Appearance required.
- Points
- 2 (passenger inside)

Refusing a party of four because the front doors are locked
A driver may lock the front doors, but must not refuse to carry a party of four, where one person has to sit in front, because the front doors are locked. The rule says such a refusal is a violation of the front-seat rule, §80-15(f)(1), so the penalty listed for that rule applies.
- Fine (published)
- Charged as §80-15(f)(1): $75. Appearance not required.

E-ZPass rules for TLC drivers
Section 80-15(d) requires every taxi, FHV and green cab operating for hire to have an E-ZPass tag (a personal tag is fine), to use it at MTA/TBTA crossings and wherever E-ZPass is accepted, to forward passengers' toll payments to the tag holder at the end of the shift, and, for some taxi drivers, to keep a replenishment account funded.
- Fine (published)
- Paragraphs (1)–(3): $100 if you plead guilty before a hearing; $150 if found guilty after a hearing. Paragraphs (4)–(5): $50 plus restitution to the E-ZPass tag holder, appearance required.

No E-ZPass tag in the vehicle
A driver must not operate a taxi, FHV or green cab for hire unless it has an E-ZPass tag. A personal E-ZPass tag counts. Inspectors at bridges, tunnels and airports write this charge when no tag is found.
- Fine (published)
- $100 if you plead guilty before a hearing; $150 if found guilty after a hearing. Appearance not required.

Not using E-ZPass at toll crossings
A driver must use E-ZPass at all MTA and Triborough Bridge and Tunnel Authority crossings and anywhere else it is accepted, rather than paying another way or being billed by mail. This keeps passengers' toll charges at the E-ZPass rate.
- Fine (published)
- $100 if you plead guilty before a hearing; $150 if found guilty after a hearing. Appearance not required.
35 RCNY §80-15(d)(2)TLC Rule Book, Chapter 80 (updated June 6, 2025)
Carrying too many passengers
A taxi or green-cab driver must not let more than four passengers ride in a four-passenger vehicle or more than five in a five-passenger vehicle, except that one extra child under 7 held on an adult's lap in the back must be accepted. No TLC vehicle may carry more passengers than its DMV registration allows.
- Fine (published)
- $100 if you plead guilty before a hearing; $150 if found guilty after a hearing. Appearance not required.
